COSTA MESA, Calif., Oct. 1, 2026 /PRNewswire/ — The following statement is being issued by Simpluris, Inc., Court-appointed Notice Administrator for the Public Water System (“PWS”) Settlements with four Settling Defendants in the Aqueous Film-Forming Foams (AFFF) Products Liability Multi-District Litigation.
Four proposed class action settlements have been reached in the AFFF Products Liability Litigation, MDL No. 2:18-mn-2873-RMG, pending in the United States District Court for the District of South Carolina.
The Settlements resolve certain claims against Carrier Global Corporation (“Carrier”), Archroma U.S., Inc. (“Archroma”), Amerex Corporation (“Amerex”), and Nation Ford Chemical Company (“Nation Ford”) relating to alleged PFAS contamination of drinking water supplied by Public Water Systems. The Settling Defendants deny liability. The litigation continues against other defendants.
WHAT DO THE SETTLEMENTS PROVIDE?
The four Settlements provide more than $149 million for eligible Public Water Systems:
- Carrier: $129.2 million, plus applicable Net Water Provider Insurance Proceeds (if any)
- Archroma: $14 million
- Amerex: $4 million
- Nation Ford: $1.875 million
The amount an eligible Public Water System may receive will depend on the applicable Allocation Procedures and information submitted to the Claims Administrator.
WHAT PUBLIC WATER SYSTEMS ARE INCLUDED?
The Settlement Classes generally include every active Public Water System in the United States that:
(1) has one or more Impacted Water Sources as of July 31, 2026; or
(2) was required to test for certain PFAS under UCMR-5, or otherwise serves more than 3,300 people according to SDWIS.
Certain Public Water Systems are excluded. Complete Settlement Class definitions and exclusions are available at the Settlement Website.
WHAT PUBLIC WATER SYSTEMS NEED TO KNOW
Participating in the Settlements: Eligible Public Water Systems must submit the required claim information to receive payment. Public Water Systems that previously submitted claim information to the Claims Administrator for an earlier Public Water System settlement may submit the same information again and may update previously submitted information as necessary.
Objecting to the Settlements: Public Water Systems that do not opt out may object to one or more of the Settlements by November 23, 2026.
Opting Out of the Settlements: Public Water Systems that do not wish to participate in one or more of the Settlements must submit a Request for Exclusion by December 22, 2026. A Public Water System that excludes itself from a Settlement will not receive money from that Settlement and will retain its right to pursue the claims covered by that Settlement separately.
Doing Nothing: Public Water Systems that take no action will remain in the applicable Settlement Classes and will be bound by the Settlements and their releases.
Final Fairness Hearing: The Court will hold a Final Fairness Hearing on January 15, 2027, at 10:00 a.m. EST to decide whether to approve the Settlements. Public Water Systems are not required to attend.
